| Abstract: This interim final rule implements certain provisions of the American Recovery and Reinvestment Act of 2009 (Recovery Act), which was enacted in order to promote economic recovery by preserving and creating jobs. SBA is working to implement Recovery Act programs that will assist small businesses most impacted by the severe economic conditions facing the Nation. The rule would amend the SBIC program regulations by implementing section 505 of the Recovery Act. Specifically, this rule increases the maximum amount of SBA leverage available to an SBIC, changes the calculation of the maximum investment size that an SBIC is permitted to make, and simplifies the requirement for an SBIC to devote a portion of its investment activity to smaller enterprises. SBA finds that good cause exists to publish this rule as an interim final rule in light of the urgent need to help small businesses sustain and survive during this economic downturn. Advance solicitation of comments for this rulemaking would be impracticable, contrary to the public interest, and would harm those small businesses that need immediate access to capital. | |
