Abstract:

SBA has undertaken this deregulatory effort pursuant to Executive Order 14219, which instructed Federal Agencies to review all regulations for consistency with law and Administrative policy and rescind or modify these regulations, as appropriate.  To that end SBA has reviewed its regulations and is removing superfluous, outdated, unnecessary or redundant regulations; streamlining and consolidating regulations affecting small businesses and SBA Lenders, making technical corrections and clarifications, strengthening program oversight, and otherwise reducing unnecessary regulatory burdens and increasing flexibility. The proposed rule is specifically designed to streamline the business loan program operations by simplifying and clarifying existing regulatory language and by eliminating unnecessary, irrelevant, or obsolete provisions.  For example, SBA is proposing to amend several introductory sections and Subpart H of 13 CFR part 120 by removing provisions that are descriptive, unnecessary, or redundant. The proposed rule also streamlines the regulatory code by eliminating rules in, for example, Subpart C for obsolete or inactive loan programs, consolidating and clarifying regulations for an active program, and making minor technical corrections.  In addition, SBA is proposing several amendments to, for example, Subparts D, E and I to consolidate duplicative provisions, remove unnecessary or outdated requirements, and clarify existing language.
