| Title: FAR Case 2009-005, Use of Project Labor Agreements for Federal Construction Projects | |
| Abstract: The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (the Councils) are amending the Federal Acquisition Regulation (FAR) to implement Executive Order (E.O.) 13502, Use of Project Labor Agreements for Federal Construction Projects, 74 FR 6985, published February 11, 2009. This E.O. revokes E.O. 13202 of February 17, 2001, which prohibited executive departments and agencies from requiring Government contractors and subcontractors to enter project labor agreements. The new E.O. encourages Federal departments and agencies to consider the use of project labor agreements for Federal construction projects where the total cost to the Government is more than $25 million. This is a significant regulatory action and, therefore, was subject to review under section 6(b) of Executive Order 12866, Regulatory Planning and Review, dated September 30, 1993. This rule is not a major rule under 5 U.S.C. 804. | |
