Title: FAR Case 2009-036, Uniform Suspension and Debarment Requirement 
Abstract: DoD, GSA, and NASA published an interim rule amending the Federal Acquisition Regulation (FAR) to implement section 815 of the National Defense Authorization Act for Fiscal Year 2010. Section 815 extends the flowdown of the restriction on subcontracting to lower tier subcontractors that have been suspended or debarred, with some exceptions for commercial items and commercially available off-the-shelf items. This rule states that for contracts 30,000 dollars and over, unless there is a compelling reason to do so, contractors cannot award subcontracts to companies who are debarred, suspended, or proposed for debarment. The rule does not apply to COTS item contracts and for commercial item contracts only at the first tier.
