Abstract:

DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to change the definition of "commercial item" at 41 U.S.C. 103(8).  Specifically, the rule broadens the definition of commercial item to include a non developmental item sold in substantial quantities, on a competitive basis, to multiple foreign governments. The rule reduces regulatory burden by increasing the use of commercial item contracting. This change will implement section 847 of the NDAA for FY 2018.
