Title: Protection of Bald Eagles and Definition
Abstract: This proposed rule would establish a regulatory definition of "disturb." The Bald and Golden Eagle Protection Act prohibits take of eagle. Take is defined by the Act to include "disturb." This rule is necessary in the event the bald eagle is removed from the list of threatened species under the Endangered Species Act. The BGEPA will become the primary law protecting bald eagles.
