Abstract: On August 12, 2009, the U.S. District Court for the District of Columbia denied the Government's request that the court vacate and remand the Excess Spoil/Stream Buffer Zone rule published on December 12, 2008. Therefore, the Department intends to initiate notice and comment rulemaking to address issues arising from that rule. As initial steps, the agency intends to prepare both an advance notice of proposed rulemaking and a supplement to the environmental impact statement to evaluate additional alternatives. | |
