Title: Identification of Non-Hazardous Materials That Are Solid Wastes | |
Abstract: The Agency is considering proposing to define whether non-hazardous secondary materials used as fuels or ingredients in combustion units are solid wastes under the Resource Conservation and Recovery Act (RCRA). This in turn will assist the Agency in developing regulatory standards under sections 112 and 129 of the Clean Air Act (CAA). If the secondary material is considered a "solid waste," then the unit that uses the secondary material would be subject to CAA section 129 requirements. The meaning of "solid waste" as defined under RCRA is important because CAA section 129, which regulates emissions from sources that combust solid wastes, states that the term "solid waste" shall have the meaning "established by the Administrator [pursuant to RCRA]." | |
