Title: Withdrawal of the Emergency Rule to Close a Portion of Federal Waters in the Gulf of Mexico in Response to the Deepwater Horizon Oil Spill 
Abstract: An oil spill occurred on April 23, 2010, in the Gulf of Mexico, approximately 50 miles off of the Louisiana coast. At the time of this rulemaking, National Oceanic and Atmospheric Administration estimated that oil leaking from the incident site may have be as much as 5,000 barrels a day or more. Several agencies responded to the oil spill, and conducted clean-up activities in the vicinity. To prevent interference with safety personnel, an emergency rule was necessary to close the Federal Waters to all fishing activities near the incident site and the oil slick. The circumstances that created the need for emergency short-term fishing closures no longer exist. The National Marine Fisheries Service and the U.S. Food and Drug Administration have determined that seafood from all previously closed areas of the Gulf Exclusive Economic Zone due to the oil spill is safe for human consumption. Therefore, NMFS has withdrawn the emergency regulations that established a protocol for closing and reopening portions of the Gulf, South Atlantic, and Caribbean exclusive economic zones that were or could potentially be affected by the oil spill.
