Title: Petition for Non-See-Through Containers for Torch Fuel and Lamp Oil | |
Abstract:
On behalf of Bettsy Bumpas, John L. Branum, attorney at law, submitted a petition, dated May 9, 2011, requesting that the Commission initiate a rulemaking to require that torch fuel and lamp oil be packaged in non-see-through containers. Specifically, the petitioner asserts that certain petroleum distillates, including torch fuel and lamp oil as currently packaged, resemble juice. The petitioner states that because young children enjoy the taste of juice and are accustomed to drinking it regularly, packaging petroleum distillates in clear plastic bottles poses a risk of injury to children because they may mistake it for juice. The request was docketed on July 7, 2011, as Petition PP 11-1, under the Poison Prevention Packaging Act (PPPA). On July 14, 2011, the Commission voted unanimously to approve publication of a notice in the Federal Register to solicit public comments on the petition. The notice was published in the Federal Register on July 26, 2011. The comment period closed on September 26, 2011. Mr. Branum requested an extension of the comment period, and on October 17, 2011, the Commission published a notice reopening the comment period for an additional 30 days. That comment period closed on November 16, 2011. CPSC staff reviewed and responded to submitted comments and on September 12, 2012, sent a briefing package to the Commission for consideration. On October 3, 2012, the Commission voted unanimously (4-0) to defer the petition, directing staff to monitor the appropriate standards development organizations regarding the status of voluntary standards activities related to the hazards posed to children from torch fuel and lamp oil, including hazards associated with the color and design of torch fuel and lamp oil containers, the use and design of secondary containers principally intended to house torch fuel and lamp oil, and the color and smell of torch fuel and lamp oil. Staff is actively engaged in voluntary standards activity, as directed by the Commission. |
