Title: Amendments to Application Procedures and Criteria for Approval; Credit Counseling Agencies and Debtor Education Providers | |
Abstract:
This rule would amend the current regulations regarding procedures and criteria United States Trustees use when determining whether applicants seeking to become and remain approved nonprofit budget and credit counseling agencies ("credit counseling agencies") or providers of a financial management course ("debtor education providers") satisfy all the prerequisites of the United States Code and applicable Executive Office for United States Trustees regulations. Under current law, an individual may not be a debtor under title 11 of the United States Code, unless during the 180-day period preceding the date of filing a bankruptcy petition, the individual receives adequate counseling from a credit counseling agency that is approved by the United States Trustee. Additionally, individual debtors must participate in debtor education before receiving a discharge of debts. The amendments would clarify procedures relative to agency and provider obligations toward individuals with limited English proficiency and clarify notice requirements when agencies and providers are involved in certain consumer protection actions. |
