Title: Criminal History Records Checks (CHRC) 
Abstract:

The Transportation Security Administration (TSA) will consolidate all requirements which relate to criminal history record checks (CHRC) in another rulemaking action, RIN 1652-AA70, Amending Vetting Requirements for Employees With Access to a Security Identification Display Area (SIDA). Section 3405 of title III of the FAA Extension. Safety, and Security Act, 2016 (Aviation Security Act of 2016), Public Law 114-190 (130 Stat. 615, July 15, 2016) requires TSA to revise its regulations to enhance the eligibility requirements and disqualifying criminal offenses for individuals seeking or having unescorted access to a SIDA. In the final rule, TSA will also respond to the comments submitted in response to this RIN, a final rule published by the Federal Aviation Administration (FAA) in December 2001 requiring each airport operator and aircraft operator with a security program under 14 CFR parts 107 or 108 to conduct fingerprint-based CHRCs for certain individuals, including those with access to the SIDA. This rulemaking was originally listed as RIN 2120-AH53 for the FAA. Rules governing civil aviation security were transferred from the FAA to TSA. Parts 107 and 108 of title 14 of the Code of Federal Regulations (CFR) on Airport Security and Aircraft Operator Security, respectively, are now codified in 49 CFR parts 1540, 1542, and 1544.
