Title: ●Personnel Review Boards
Abstract:

Section 1 of this part implements the Army Disability Review Board which is an administrative agency created within the Department of the Army to review, at the request of any officer retired or released from active service, without pay, for physical disability pursuant to the decision of a retiring board or disposition board, the findings and decisions of such board. Section 2 of this part implements 10 U.S.C. 1553 for the Army Discharge Review Board. A former Army service member is entitled to an honorable discharge if a less than honorable discharge was issued to the service member who was discharged before 1 January 1975 as a result of an administrative proceeding in which the Army introduced evidence developed by or as a direct or indirect result of compelled urinalysis testing administered for the purpose of identifying drug abusers (either for the purpose of entry into a treatment program or to monitor progress through rehabilitation or follow up). Section 3 of this part implements 10 U.S.C. 1552 for the Army Board for Correction of Military Records. This section prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the Army Board for Correction of Military Records. This part will be incorporated into 32 CFR part 70 to create a single DoD-level rule for Discharge Review Boards and Boards for Correction of Military Records.  Costs savings associated with this part are consolidated under 32 CFR part 70.
