Title: Inapplicability of Certain Defense-Unique Laws to Commercial Items (DFARS Case 2017-D010) | |
Abstract:
DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement section 874 of the National Defense Authorization Act for FY 2017. Section 874 amends 10 U.S.C. 2375 to address the relationship of commercial item provisions to other provisions of law and regulation. To implement section 874, this rule proposes to limit the inclusion of contract clauses in DoD acquisitions of commercial items. The rule also proposes to restrict flowing down contract clauses to subcontracts under contracts for the acquisition of commercial items, including commercially available off-the-shelf items. |
