EPA/OCSPP RIN: 2070-AK40 Publication ID: Fall 2017
Title: Extension of Compliance Dates; Agricultural Worker Protection Standard
Abstract:

In November 2015, EPA revised the Worker Protection Standard (WPS) and required compliance with most of the revised requirements by January 2, 2017. In February 2017, the National Association of State Departments of Agriculture (NASDA) submitted a petition requesting EPA to postpone this compliance date to at least January 2, 2018 or until adequate compliance tools have been completed and states have the necessary tools, time and resources to implement the rule changes and provide compliance assistance to the regulated community. On May 11, 2017, EPA granted the petition and committed to beginning the regulatory process to formally extend the compliance date for all revised provisions of the WPS. This regulation is needed to adjust the compliance date. In addition, this regulation would temporarily reinstate the 1992 WPS requirements to ensure there are protections in place for farmworkers and pesticide handlers until the new compliance date is reached.
