Title: ●Inapplicability of Additional Defense-Unique Laws to Commercial Items (DFARS Case 2018-D074) 
Abstract:

DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to partially implementsection 837(a) of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2019 to address commercial item applicability for DFARS-unique statutes and associated contract clauses issued from October 13, 1994, through December 31, 2014. DFARS Case 2017-D010 addresses the period on or after January 1. 2015. Nonstatutory FAR contract clauses issued in this same time period are being reviewed on or after January 1, 2015, are being reviewed under FAR Case 2018-019. The requirements of section 837(b) and (c) will be addressed under DFARS Case 2018-D066.
