Title: ●Noninsured Crop Disaster Assistance Program (NAP) 
Abstract:

The final rule will amend the NAP regulation in 7 CFR part 1437. NAP provides financial assistance to producers of noninsurable crops to protect against natural disasters that result in lower yields or crop losses, or prevented crop planting. The rule implements changes consistent with provisions in the Agriculture Improvement Act of 2018 (2018 Farm Bill). In addition to the catastrophic level NAP coverage, higher levels of coverage (buy-up coverage) is available ranging from 50 to 65 percent of production, in 5 percent increments, at 100 percent of the average market price. This rule implements the change to payment limits made by the 2018 Farm Bill, which specifies that payments for losses to crops with catastrophic coverage are subject to a payment limitation of $125,000, and payments for losses to crops with buy-up coverage are subject to a separate payment limitation of $300,000. The rule increases the NAP service fees from $250 to $350 per crop, increases the maximum per producer per county from $750 to $825 , and increases the maximum per producer for all counties from $1,875 to $1,950. It also extends the service fee waiver and 50 percent premium reduction to eligible veteran farmers and ranchers.  The rule will amend native sod provisions to make them applicable in the specified states for any crop enrolled in NAP that was tilled after December 20, 2018, for no more than 4 years during the first 10 years of cropping. The rule will specify that NAP is available when catastrophic risk protection under subsection (b) of section 508 of the Federal Crop Insurance Act (7 U.S.C. 1508) and additional coverage under subsections (c) and (h) are not available or is only available under a policy that provides coverage for specific intervals based on weather indexes or under a whole farm plan of insurance. The rule will also make several minor discretionary changes to improve program integrity and clarify existing NAP requirements.
