Title: ●Continuing Authorities Programs 
Abstract:

The existing regulation provides policies and procedures for seven legislative authorities under which the Secretary of the Army, acting through the Chief of Engineers, is authorized to plan, design and construct certain types of water resource improvements without specific Congressional authorization. The Continuing Authorities Program is used to plan and implement projects of limited size, scope and complexity in an accelerated manner compared to tradition USACE projects. Programs include small flood risk management projects, ecosystem restoration projects, clearing and snagging of waterways for navigation and flood risk management projects, emergency streambank protection, small navigation projects, small beach erosion and shoreline projection projects, and mitigation for shoreline damages from attributable to navigation works. This final rule action is largely administrative in nature, removing unnecessary and outdated CFR text which will provide clarity and reduce confusion to the public. The same content can be found in the Corps’ publication of appendix F (Continuing Authorities Program) in ER 1105-2-100, Planning Guidance Notebook. The rule does not place a burden on the public, therefore its repeal does not provide a burden reduction or cost savings.
