DoD is issuing a proposed rule to amend the Defense Federal Acquisition Regulation Supplement to modify the clause at DFARS 252.243-7001, Pricing of Contract Modifications. The text of DFARS clause 252.231-7000, Supplemental Cost Principles, which states that the allowability of costs will be determined in accordance with the cost principles in effect on the date of contract award, can be incorporated into DFARS clause 252.243-7001. Both of these clauses address the cost principles that will be used when addressing costs under certain fixed price contracts and serves as an agreement between both parties. The modification of this DFARS clause supports a recommendation from the DoD Regulatory Reform Task Force.
