Title: Interpretation of "Used in Routine Agricultural Operations" Under EPCRA | |
Abstract:
There is no longer a need for this rulemaking. This rulemaking would have assisted persons, including farmers, in determining whether certain EPCRA requirements apply to their facilities. In March 2018, Congress enacted the Fair Agricultural Reporting Method Act or FARM Act. As a result, EPA is no longer advancing the rationale concerning "routine agricultural operations" and instead interprets the FARM Act as aiding farms in determining whether certain EPCRA requirements apply to their facilities. EPA's interpretation of the FARM Act is set out in the rulemaking entitled, "Emergency Release Notification Regulations on Reporting Exemption for Air Emissions From Animal Waste at Farms; Emergency Planning and Community Right-to-Know Act" (83 FR 56791, November 14, 2018). |
