Abstract:
The EPA is proposing to revise the permitting registration process for certain oil and gas sources under its Federal Implementation Plan (FIP) for Managing Air Emissions from True Minor Sources Engaged in Oil and Natural Gas Production in Indian Country by streamlining the form submissions sequence. The current rule requires sources performing their own screening analyses for threatened or endangered species; or designated critical habitat; and historic properties (aka protected resources) to first submit their analysis, and then, following approval by the reviewing authority, submit their part 1 Registration Form (part 1 Form). The source cannot begin construction until at least 30 days following submittal of its part 1 Form. The EPA is proposing to allow sources to submit the part 1 Form concurrently with the protected resource screening analysis. Provided that the reviewing authority has approved the screening analysis and a minimum of 30 days has passed since the part 1 Form was submitted, the source can begin construction. This change would reduce the registration process by up to 30 days without impacting the screening analysis review by EPA. This change is consistent with how the existing rule treats sources covered under a permit by rule. |
