Title: ●Updates to Bayh-Dole Implementing Regulations | |
Abstract:
Changes to 37 CFR 401, 404, and 501 to reduce regulatory impediments for technology transfer by eliminating unnecessary language and modifying language to clarify confusing provisions that have created a burden in complying with the intent of the Bayh-Dole Act. The proposed deletions remove a significant amount of regulations that are unnecessary or duplicative. The added language provides additional clarity in regulating march-in rights, subject invention and utilization reporting requirements, U.S. industry preference, and other regulations that impact the transfer of technology from federally funded research and development. The proposed rulemaking aims to improve the transition of federally funded innovations from the laboratory to the marketplace by reducing the regulatory burdens for technology transfer. |
