Title: Classification for Victims of Severe Forms of Trafficking in Persons; Eligibility for T Nonimmigrant Status
Abstract:

The T nonimmigrant classification was created by the Victims of Trafficking and Violence Protection Act of 2000, Public Law 106-386. The classification was designed for eligible victims of a severe form of trafficking in persons who aid law enforcement with their investigation or prosecution of the traffickers, and who can establish that they would suffer extreme hardship involving unusual and severe harm if they were removed from the United States. The rule finalizes the interim final rule published in the Federal Register at 81 FR 92266 on December 19, 2016, which streamlined application procedures and responsibilities for the Department of Homeland Security (DHS), provided guidance to the public on how to meet the requirements to obtain T nonimmigrant status, and implemented legislative amendments to the T nonimmigrant status provisions in the Immigration and Nationality Act.
