The EPA proposed water quality criteria for selenium in the San Francisco Bay and Delta of California (Bay and Delta) on July 15, 2016. If finalized, these regulations would protect Bay and Delta aquatic life and aquatic-dependent wildlife, including species listed as threatened and endangered under the federal Endangered Species Act, from the harmful effects of exposure to toxic levels of selenium. A consent decree with Our Children's Earth Foundation and Ecological Rights Foundation provided that if the EPA proposed this rule by June 2016, the EPA's consent decree deadline for proposing selenium criteria for the rest of California would be extended from November 2016 to November 2018. In the event that the EPA approves selenium criteria for the Bay and Delta submitted by California prior to promulgation of a final federal rule, the EPA would no longer be obligated to finalize criteria for such waters
