Abstract:
The Equal Employment Opportunity Commission (EEOC or Commission) proposes to amend its procedural regulations to establish rules for issuing guidance, in compliance with the requirements of Executive Order 13891. These rules make guidance documents readily available to the public, ensure that guidance will be treated as non-binding, require a notice and public comment period for significant guidance, and establish a public petition process for the issuance, amendment, or repeal of guidance.

Overall Description of Deadline: Executive Order 13891 (Oct. 9, 2019) requires that agencies issue regulations concerning their procedures for issuing guidance within 300 days of the Office of Management and Budget issuing implementing guidance for the Executive Order. That guidance was issued on October 31, 2019, in OMB Memo M-20-02. Therefore, the deadline for issuance of this regulation in final form is August 26, 2020. |
