Title: ●Chartering and Field of Membership 
Abstract:

The NCUA Board (Board) proposed to amend its chartering and field of membership (FOM) rules with respect to applicants for a community charter approval, expansion, or conversion. Specifically, the Board proposed to re-adopt a provision to allow an applicant to designate a Combined Statistical Area (CSA), or an individual, contiguous portion thereof, with a population up to 2.5 million, as a well-defined local community.  Separately, in accordance with an August 2019 opinion and order issued by the DC Circuit Court of Appeals with respect to communities based on a Core-Based Statistical Area (CBSA) or a portion thereof, the Board provided further explanation and support for its elimination of the requirement to serve the CBSA’s core area.  In addition, the Board proposed to clarify existing requirements and add explicit provisions to its rules to address serving low and moderate income communities in the selection of community-based FOMs.  The Board is reviewing the public comments on the proposed rule and will move toward a final rule.
