Title: Nondiscrimination Obligations of Federal Contractors and Subcontractors: Procedures to Resolve Potential Employment Discrimination 
Abstract:

This Final Rule revises regulations at 41 CFR parts 60-1, 60-2, 60-300, and 60-741, which implement the nondiscrimination and affirmative action provisions of Executive Order 11246 (as amended), section 503 of the Rehabilitation Act (as amended), and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (as amended), respectively, to codify certain procedures and documents OFCCP uses to resolve potential violations of these laws by federal contractors and subcontractors.

Statement of Need:

The Department published the Final Rule to increase clarity and certainty for OFCCP stakeholders, and enhance OFCCP's efficiency in remedying employment discrimination.

Summary of the Legal Basis:

Executive Order 11246 (as amended), section 503 of the Rehabilitation Act (as amended), and the Vietnam Era Veterans' Readjustment Assistance Act (as amended).

Alternatives:

The Department considered leaving OFCCP’s resolution procedures described only in agency subregulatory guidance. The Department also considered different types of evidentiary standards for OFCCP to issue Predetermination Notices and Notices of Violations.

Anticipated Costs and Benefits:

The Department estimates that the Final Rule would result in a total annualized cost of $81,215 at a discount rate of 7 percent in 2016 dollars. Detailed tables identifying rule familiarization costs were addressed in the final rule.
