Title: Cross-State Air Pollution Rule (CSAPR) Update Remand for the 2008 Ozone NAAQS 
Abstract:

On September 7, 2016, EPA issued the Cross-State Air Pollution Rule (CSAPR) Update to address interstate transport of ozone for the 2008 ozone national ambient air quality standards (NAAQS) in the eastern United States. This rule - the CSAPR Update Remand for the 2008 ozone NAAQS - addresses the remand of the CSAPR Update by the U.S. Court of Appeals for the D.C. Circuit on September 13, 2019 in Wisconsin v. EPA. This action will also have the effect of addressing the outstanding obligations that resulted from the D.C. Circuit’s vacatur of the CSAPR Close-out on October 1, 2019, in New York v. EPA. This action meets a court-ordered deadline of March 15, 2021, to take final action addressing the remaining 2008 ozone NAAQS transport obligations of seven states, established by order of the federal district court for the Southern District of New York on July 28, 2020, in New Jersey v. Wheeler. EPA has also committed to meeting the March 15, 2021 deadline as to thirteen additional states in a related case, Downwinders At Risk v. Wheeler, which is pending in the federal district court for the District of Columbia.
