Title: Eagle Permits; Incidental Take | |
Abstract:
The Department of the Interior entered a settlement agreement with the Energy and Wildlife Action Committee in response to litigation over technical legal aspects of the eagle incidental take regulations at 50 CFR 22.26. The settlement requires the Service: to publish a proposed rule revising our eagle incidental take regulations by August 31, 2021, and to issue a final rule or notice of withdrawal of the proposed rule by August 31, 2022. This proposed rule would remove the requirement for long-term eagle incidental take permittees to use independent third parties to monitor eagle take under the permit. |
