Title: ●Clean Water Act Section 401: Water Quality Certification | |
Abstract:
Clean Water Act (CWA) section 401 requires that any applicant for a Federal license or permit to conduct an activity which may result in a discharge to navigable waters obtain, from the state or tribe in which the discharge would originate, certification that the discharge will comply with applicable provisions of the CWA. In accordance with Executive Order 13990, the EPA will review and revise as appropriate the June 2020 regulation titled Clean Water Act Section 401 Certification Rule.” Recognizing that section 401 is a direct grant of authority to states and tribes, EPA intends to conduct stakeholder outreach with states and tribes to further inform this review. |
