Title: ●Arizona State Plan for Occupational Safety and Health 
Abstract:

Arizona administers an occupational safety and health plan (State Plan) approved by the federal Occupational Safety and Health Administration (OSHA) under Section 18(e) of the Occupational Safety and Health Act of 1970 (the OSH Act). The State Plan received final approval from OSHA on June 20, 1985. Arizona has failed to maintain its commitment to provide a program for employee safety and health protection that meets the requirements of section 18(c) of the OSH Act and is at least as effective as the Federal OSHA program in providing employee safety and health protection at covered workplaces, among other things by failing its obligations with respect to OSHA’s COVID-19 Emergency Temporary Standard for Healthcare in a timely manner. Therefore, OSHA is considering whether to propose to revoke its affirmative determination under Section 18(e) of the OSH Act granting final approval to the State Plan. If OSHA determines that such revocation is appropriate, the Arizona State Plan will revert to initial approval and Federal authority for discretionary concurrent enforcement would resume, allowing Federal OSHA to ensure that private sector employees in Arizona are receiving protections that are at least as effective as those afforded to employees covered by Federal OSHA.
