The Agency received two petitions to add 1- bromopropane (1-BP) to the list of Hazardous Air Pollutants (HAP) under section 112 of the Clean Air Act (CAA). After review and comment, the EPA found that the petitioners met the requirements contained in CAA section 112(b)(3) and granted the petition. The final action granting the petitions was published on June 18, 2020 (85 FR 36851). On June 11, 2021 (86 FR 31225), EPA issued an advanced notice of proposed rulemaking to solicit comments and information on the impacts of listing 1-BP. This subsequent action adds 1-BP (CAS 106-94-5) to the CAA section 112(b)(1) list of HAP by modifying 40 CFR part 63, subpart C, which will result in regulation of 1-BP under section 112 of the CAA. This will be the first time that a HAP is added to the HAP list since the 1990 CAA was promulgated.
