Title: Affirmatively Furthering Fair Housing; Restoring Statutory Definitions and Certifications (FR-6249) | |
Abstract:
The Fair Housing Act requires that HUD affirmatively further the purposes and policies of the Fair Housing Act, which is title VIII of the Civil Rights Act of 1968, as amended. HUD’s Preserving Community and Neighborhood Choice (PCNC) final rule, issued on August 7, 2020, effectuated a substantial departure from prior agency and judicial interpretations of the AFFH obligation and undermined HUD’s and program participants’ ability to comply with their AFFH obligation, without an adequate basis for this departure and without providing the public the opportunity to comment on the overhaul of the long-accepted understanding of what it means to affirmatively further fair housing. HUD is issuing this interim final rule to restore legally supportable definitions and certifications related to the obligation to Affirmatively Further Fair Housing (AFFH). |
