Title: Federal Management Regulation (FMR); FMR Case 2019-102-01, Replacement of Personal Property Pursuant to the Exchange/Sale Authority | |
Abstract:
The General Services Administration (GSA) is proposing to amend the Federal Management Regulation (FMR) in response to the Government Accountability Office Report 19-33, GSA and VA Have Opportunities to Improve the Exchange/Sale Process, November 2018. The proposed amendments include the following: (1) revise the definition for "similar” in to make it more specific, (2) clarify the differences between the exchange/sale authority and the "normal” excess/surplus disposal process, (3) revise items from the "prohibited list,” (4) clarify that an exchange or sale under this part may occur after the acquisition of the replacement property, (5) add language stating that deviations to FMR 102-39.80 are not permitted, thereby clarifying that except as otherwise authorized by law, all exchange allowances or proceeds of sale under this part will be available only during the fiscal year in which the property was exchanged or sold and for one fiscal year thereafter for the purchase of replacement property, (6) update the reporting policy and process, and (7) provide additional guidance to agencies, such as referring agencies to Bulletin B-48 for additional information. |
