Title: Administrative Rules for Claimant Representation and Direct Payment to Entities | |
Abstract:
We propose to change our fee rules to permit direct payment to entities with salaried employees who perform appointed representational services in matters before the agency. We also propose the following new stipulations for representatives, including: 1) imposing a deadline(s) on when representatives must file their fee petitions and supporting documents; 2) requiring representatives and non-representative entities to register with the agency, irrespective of whether they want access to the electronic claim folder; and 3) mandating the use of a prescribed form (e.g., SSA-1696) for the appointment of a representative. We also propose changes to the educational requirements for direct pay non-attorney representatives to provide parity for individuals with intermediate degrees (associates) and two-years of work experience. |
