Abstract:
The Coast Guard will remove an incorrect statement about field preemption of State or local regulations on the topic of inland navigation. The appropriate analysis is one of conflict preemption rather than field preemption. Removing the language from the CFR will confirm the ability of States to regulate inland navigation as they have historically done. |
