Title: Test Procedure Interim Waiver Process 
Abstract:

On December 11, 2020, the U.S. Department of Energy (DOE) published a final rule in the Federal Register that made significant revisions to its procedures for processing petitions for test procedure interim waivers found in 10 CFR 430.27 and 10 CFR 431.401. 85 FR 79802. DOE reviewed this rule as required by Executive Order 13990, Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis, 86 FR 7037 (January 25, 2021). DOE published a notice of proposed rulemaking on August 20, 2021 (86 FR 46793). The proposed revisions addressed areas of the test procedure interim waiver process regulations that may result in alternate test procedures that are inconsistent with the purpose and requirements of the Energy Policy and Conservation Act, and that otherwise appear not to effectuate the statute properly. DOE published a final rule on December 14, 2021.
