This rulemaking will address byproduct emissions of HFC-23 from the manufacture of class II ozone-depleting substances (ODS) for use as feedstocks. EPA is in the process of completely phasing out production of class II ODS with limited exemptions. Given one of these exemptions includes the manufacture for feedstock and continues indefinitely, EPA would set a limit that would address byproduct emissions of HFC-23 (a substance with a very high global warming potential). On September 29, 2021, EPA proposed to limit emissions of HFC-23 from plants manufacturing HCFCs, by capture and employment for a commercial use or destruction using a technology approved by EPA, thereby ensuring it is not directly emitted.
