Title: Economic Growth Regulatory Relief, and Consumer Protection Act: Implementation of National Standards for the Physical Inspection of Real Estate (NSPIRE) (FR-6012) | |
Abstract:
The Consolidated Appropriations Act of 2016 directed HUD to implement a single inspection protocol for public housing and voucher units. In addition, section 209 of the Economic Growth Regulatory Relief and Consumer Protection Act requires that program inspections apply existing physical inspection standards for projects assisted under section 8 of the 1937 Act to small and predominantly rural Public Housing Agencies. Accordingly, this rule replaces HUD's several physical inspection standards with a single inspection standard which would apply across HUD’s programs. This new standard will promote resident health and safety and reduce compliance burden by eliminating the need to comply with several different inspection standards. Additionally, this rule will reduce burdens on small rural public housing agencies by implementing section 38(a)(2)(b) of the 1937 Act and establish a subpart which provides for alternative definitions and procedures for small rural PHAs. Finally, this rule will implement provisions in the Consolidated Appropriations Act of 2020 which require the installation of Carbon Monoxide Alarms in Federally Assisted Housing with an effective date of December 27, 2022. The rule will establish that HUD will publish the inspection procedures through Federal Register notices with the opportunity for public input prior to implementation and at least once every three years. |
