Title: Affiliation and Lending Criteria for the SBA Business Loan Programs 
Abstract:

SBA will publish a notice of proposed rulemaking to solicit comments from the public and industry regarding changes to credit criteria, including certain loan conditions and criminal history for the business loan programs and SBA’s affiliation rules. SBA is seeking comments on streamlining credit/underwriting requirements including hazard insurance to better sync with lender participant policies for similarly sized non-SBA guaranteed commercial loans. SBA is seeking comments on the treatment of associates with criminal background focusing on the issues of equity, criminal justice and employment. Under SBA’s affiliation rules for business loan programs, SBA may find an applicant to be affiliated with another concern based on several principles of affiliation. The concepts of affiliation need to be clear and easy to apply for borrowers, lenders, and other industry associates to ensure program compliance. SBA proposed to streamline the principles of affiliation for all of the business loan programs and will review comments received and, as appropriate, amend the regulations governing affiliation applicable to all of the SBA business loan programs.
