Title: Federal-State Unemployment Compensation (UC) Program; Confidentiality and Disclosure of State UC Information | |
Abstract:
The Employment and Training Administration (ETA) is considering comprehensive updates to the unemployment compensation (UC) confidentiality regulation found at 20 CFR 603. The existing regulation took effect in 2006 and underwent minor updates in 2016 in response to the Workforce Innovation and Opportunity Act (WIOA). ETA is now considering an update that would incorporate a requirement for states to provide ongoing access for the Department’s Office of Inspector General (OIG) to state unemployment compensation data for purposes of unemployment compensation program oversight and audits. In addition, the agency is considering addressing several other items that states and stakeholders have raised over the years, including addressing questions around sharing information across the workforce system (including with local workforce boards), the permissibility and use cases of sharing information with agencies within the Department for analysis and evaluation, federally-recognized Indian tribes, data warehousing, and the use of contractors/subcontractors. Stakeholders include state agencies, state and local workforce boards, worker advocates, employer advocates, and private sector entities (e.g., research institutions and third-party vendors). |
