Title: Adjudication and Civil Penalty Procedures Under the Energy Policy and Conservation Act | |
Abstract:
Section 6303 of Title 42 of the United States Code provides for an on-the-record hearing for parties issued a civil penalty notice by the United States Department of Energy (DOE) for violations of 42 U.S.C. 6302. Through a direct final rule, DOE intends to adopt regulations that establish the procedure for such hearings, the rights and obligations of the parties and presiding authorities, and the procedures for issuing civil penalty orders under 42 U.S.C. 6303. |
