Title: ●National Emission Standard for Hazardous Air Pollutants: Integrated Iron and Steel Manufacturing Facilities Rule Amendments | |
Abstract:
The action will amend the Iron and Steel Manufacturing Facilities NESHAP, 40 CFR part 63, subpart FFFFF, as required by the Clean Air Act (CAA). The Iron and Steel Manufacturing Facilities NESHAP was promulgated pursuant to section 112(d) of the Clean Air Act (CAA) on May 20, 2003, and subsequently amended on July 13, 2006. The residual risk and technology review (RTR) was promulgated pursuant to CAA sections 112(f) and 112(d)(6) on July 13, 2020. This action will address Louisiana Environmental Action Network v. EPA, 955 F.3d 1088 (D.C. Cir. 2020) (“LEAN”), in which the court held that EPA must set limits on uncontrolled hazardous air pollutant (HAP) emissions when the Agency conducts technology reviews under CAA section 112(d)(6), 42 U.S.C. section 7412(d)(6). The NESHAP establishes emission limitations and/or work practice requirements based on maximum achievable control technology (MACT) for controlling emissions of HAP from iron-making blast furnaces; steel-making oxygen furnaces; ancillary operations, such as ladling, hot metal transfer, skimming and desulfurization; and sinter plants. Pursuant to a court order issued on April 13, 2021, in California Communities Against Toxics, et al. v. Regan, Case No: 1:15-cv-00512 (D.D.C. 2017), the rule amendments must be finalized by October 26, 2023. |
