Abstract:
Section 504 of the Rehabilitation Act prohibits discrimination based on disability in the programs, activities and facilities of recipients of federal financial assistance. HUD issued its regulations implementing section 504 in 1988 and has not updated them since. HUD will seek public comment on ways it can improve its section 504 regulations and the accessibility standards for HUD-assisted facilities in order to ensure that individuals with disabilities truly have equal access to all HUD-assisted programs, activities, and facilities, such as public housing, affordable housing, homeownership programs, homeless shelters, and disaster recovery. HUD has applied the Uniform Federal Accessibility Standards (UFAS) or the HUD deeming notice, which allows the use of the 2010 ADA Standards for Title II of the ADA with a small list of exceptions, for purposes of its Section 504 accessibility standard.
