Title: Agency Waiver of Cost Accounting Standards
Abstract:

Section 820 of the FY 2017 National Defense Authorization Act, Public Law 114-328, raised the dollar cap on the authority of an executive agency to waive the applicability of the Cost Accounting Standards (CAS) on a contract or subcontract with a value of less than $15 million to a value of less than $100 million. CAS is applicable to contracts and subcontracts that meet certain dollar thresholds unless they meet the requirements for certain CAS exemptions or waivers, which include authority for the agency to waive CAS applicability for contracts or subcontracts with a value below a statutorily defined dollar cap. Section 820 raised the capped amount from $15 million to $100 million. Above this cap, the CAS Board retains the authority to waive the applicability of CAS.
