Title: Supplemental Nutrition Assistance Program: Replacement of Stolen Benefits 
Abstract:

This interim final rule implements Division HH, Title IV, section 501(a)(3) of the Consolidated Appropriations Act, 2023. Under section 501(a)(3), the Department of Agriculture, Food and Nutrition Service (FNS) is instructed to promulgate regulations that require State agencies to implement procedures for the replacement of Supplemental Nutrition Assistance Program (SNAP) benefits stolen through card skimming, card cloning, and other fraudulent means. Replacement benefits will be funded from those funds appropriated under section 18 of the Food and Nutrition Act of 2008 (7 U.S.C. 2027). SNAP recipients that have been a victim of electronic benefit theft will be substantially impacted by this rule. The rule will provide victims the ability to have some of their stolen benefits replaced. On January 9, 2023, FNS held a call with all SNAP State agencies about the requirement for States to replace stolen benefits with Federal funds. FNS received comments and questions from State agencies, which informed FNS’ guidance (Replacement of SNAP Benefits in the Consolidated Appropriations Act of 2023) on the subject, which was released on January 31, 2023. FNS has also had ongoing dialogue with States over the past several months in the course of development of State Plans to implement the provisions of the January 31 guidance. That State feedback will inform the interim final rule.
