Title: ●Supplemental Nutrition Assistance Program (SNAP): Disaster SNAP  
Abstract:

The proposed rule would establish criteria for State agencies operating a Disaster Supplemental Nutrition Assistance Program (D-SNAP). The Food and Nutrition Service (FNS) currently oversees State operation of D-SNAP through authority provided by section 412, Benefits and Distribution (42 U.S.C. 5179) of the Stafford Act. This rulemaking would codify procedures for all components of D-SNAP operation, including requesting a D-SNAP waiver, criteria for receiving approval, requirements for operating a D-SNAP, and post-disaster reporting requirements. The rule will reflect existing expectations for D-SNAP processes as well as provide recently developed flexibilities, such as virtual operation, developed in response to operations during the COVID-19 pandemic. In February 2023, three listening sessions were conducted with community partners, EBT vendors, and State agencies. These listening sessions informed this regulatory proposal by providing insight on the challenges and strengths of D-SNAP during the pandemic. The listening sessions also provided feedback on the general requirements and design of D-SNAP. This regulatory proposal is likely to substantially impact low-income households in high-risk disaster-prone areas.
