EPA is proposing a Federal Implementation Plan (FIP) to meet the contingency measure requirement of the Clean Air Act for the San Joaquin Valley nonattainment area for the 1997, 2006, and 2012 PM2.5 national ambient air quality standards (NAAQS). EPA’s obligation to issue a FIP is based on EPA’s determination on December 6, 2018 (83 FR 62720) that the State of California failed to submit state implementation plan (SIP) revisions addressing certain nonattainment plan requirements (including contingency measures) for the San Joaquin Valley for these three PM2.5 NAAQS. EPA’s FIP was due January 7, 2021. EPA has a consent decree deadline to propose a contingency measure FIP by July 31, 2023, and to finalize a contingency measure FIP by September 30, 2024, unless the state submits and EPA approves a SIP submission meeting the CM requirements at issue prior to that date.
