Title: State Implementation Plans: Restatement of SSM Policy; Findings of Inadequacy; and Amendment Provisions Applying to Excess Emissions During SSM Periods | |
Abstract:
In accordance with EPA’s policy for State Implementation Plan (SIP) provisions applying to excess emissions during periods of Startup, Shutdown and Malfunction (SSM) outlined in EPA’s 2015 SSM SIP Action, EPA is reinstating its findings of substantial inadequacy (“SIP calls”) that were withdrawn in 2020 for the states of Texas, North Carolina, and Iowa for SSM provisions in those states’ SIPs that do not comply with statutory requirements and EPA’s SSM Policy. EPA is also issuing new findings of substantial inadequacy and SIP calls for additional SSM provisions identified as deficient by the Agency. EPA issued a proposal on February 24, 2023 (88 FR 11842). |
