Title: ●National Emission Standards for Hazardous Air Pollutants, New Source Review, Federal Operating Permit, and Outer Continental Shelf Programs: Requirements for Enforceability of Limitations on PTE 
Abstract:

This rulemaking action would address the requirements for enforceability of limits on potential to emit (PTE) across multiple affected Clean Air Act programs, including the national emission standards for hazardous air pollutants (NESHAP), new source review (NSR), and title V programs. This action would establish the minimum requirements, including both legal and practicable enforceability requirements, that limitations must meet to be considered in the determination of PTE. It would also address the Court’s 1995-96 remand and vacatur of the term “federally” in the definitions of PTE in the NESHAP, NSR, and title V programs.
